Terms of Service

These Terms of Service ("Terms") govern your access to and use of the SiteDeck platform and related services (the "Service") operated by SiteDeck ("we", "our", or "us"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you confirm that you are at least 18 years old and have the legal authority to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

SiteDeck is a WebOps platform that provides website health monitoring, task management, ticket tracking, website auditing, resource management, and team collaboration tools. The Service monitors websites externally and does not require access to your hosting infrastructure, CMS credentials, or server files.

3. Accounts and Access

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to your account.

Organization administrators are responsible for managing team member access, roles, and permissions within their organization. SiteDeck provides five role levels (Admin, Manager, Contributor, Developer, Viewer) with granular per-website access control.

You may not share your login credentials with others. Each user must have their own account.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to other organizations' data or any part of the Service not intended for you
  • Interfere with or disrupt the integrity or performance of the Service
  • Use automated means to access the Service except through our provided API
  • Add websites to the platform that you do not own or have authorization to monitor
  • Upload malicious files, scripts, or content to the platform
  • Attempt to reverse-engineer, decompile, or disassemble any portion of the Service
  • Use the Service to send spam or unsolicited communications
  • Resell or redistribute the Service without our written consent

5. Subscription and Billing

SiteDeck offers tiered subscription plans based on the number of websites monitored and features included. All plans include unlimited team members. Current plan details and pricing are available at https://sitedeck.dev/#pricing.

Subscriptions are billed monthly in advance. You may upgrade or downgrade your plan at any time. Downgrades take effect at the start of the next billing cycle. We do not offer refunds for partial billing periods.

Add-on services (such as Echo AI) are billed separately at the rates listed on our pricing page and may be added or removed at any time.

All plans include a 14-day free trial. No credit card is required to start a trial. If you do not select a paid plan at the end of your trial, your access will be suspended until a plan is selected.

6. Free Trial

All plans come with a 14-day free trial. During the trial period, you have full access to the features included in the plan you select. We will not charge you until the trial period ends and you explicitly confirm your subscription.

We reserve the right to modify or discontinue the free trial offering at any time.

7. Data Ownership

You retain all ownership rights to the data you input into the Service, including website information, tasks, tickets, audit data, resources, and team configuration. We do not claim ownership of your content.

We retain the right to use anonymized, aggregated data (such as platform-wide health check statistics) to improve the Service. This data cannot be used to identify you or your organization.

8. Website Monitoring

SiteDeck performs external monitoring of websites you add to the platform. This includes HTTP requests, SSL certificate checks, DNS/RDAP lookups, PageSpeed API calls, and sitemap-based link crawling.

You represent that you have authorization to monitor any website you add to the platform. You are responsible for ensuring that SiteDeck's monitoring activity complies with the terms of service of your hosting providers and any applicable laws.

SiteDeck's health monitoring is provided on a best-effort basis. We do not guarantee the accuracy, completeness, or timeliness of health check results. Monitoring intervals, check types, and scoring algorithms may change as the platform evolves.

9. Service Availability

We strive to maintain 99.9% uptime for the Service but do not guarantee uninterrupted access. Scheduled maintenance windows will be communicated in advance when possible. We are not liable for any downtime, data loss, or service interruptions caused by circumstances beyond our reasonable control.

10. Limitation of Liability

To the maximum extent permitted by law, SiteDeck shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service.

Our total liability for any claim arising under these Terms shall not exceed the amount you paid to SiteDeck in the 12 months preceding the claim.

SiteDeck is a monitoring and operations tool. We are not responsible for the health, security, or availability of the websites you monitor through the platform. Health check results are informational and should not be relied upon as the sole basis for security or operational decisions.

11. Indemnification

You agree to indemnify and hold harmless SiteDeck and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

Either party may terminate the subscription at any time. Upon termination:

  • Your access to the Service will be revoked at the end of the current billing period
  • You may request export of your data before termination
  • We will retain your data for 30 days after termination to allow for data export requests, after which it will be permanently deleted

We reserve the right to suspend or terminate your account immediately if you violate these Terms or engage in activity that threatens the security or integrity of the Service.

13. Modifications to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

For material changes that affect your rights or obligations, we will make reasonable efforts to notify you via email at least 15 days before the changes take effect.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Alabama, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in Baldwin County, Alabama.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SiteDeck regarding your use of the Service and supersede any prior agreements.
